The Supreme court decided to set up a five-member Special Investigation Team (SIT) to re-investigate 10 crucial cases pertaining to post-Gohra violence. One of the most prominent cases being "Naroda Patia case" where the death toll hit a three digit figure.
The SIT will comprise of three IPS officers from Gujarat namely Ashish Bhatia, Geeta Johri and Shivanand Jha (in alphabetical order) and two retired out of state officers namely C V Satpathy and R K Raghavan(ex-CBI chief ) . This decision was passed by a three-judge bench comprised of Justice Alam, Justice Pasayat and Justice Sathasivam
This hearing was initiated following a petition filed by the National Human Rights Commission (NHRC). This group wanted to move the trials out of Gujarat and have them reinvestigated by an independent agency. NHRC filed the petition after a number of witnesses turned hostile and foul play was suspected. This group also claims that the Gujarat police has not conducted the investigation in a free and fair manner.
The supreme court decision was welcomed by HCRC and the Gujarat government counsel.
The latest reports indicate that the supreme court did not consider the NHRC and NGO'a plea of probing by CBI Or transfer of the case out of Gujarat. So the retrial is a bittersweet victory for NHRC as they got some victory but not everything they asked for.
